Waiver 2025 Jan

I, the participant, acknowledge that I am voluntarily participating in activities conducted by Peak Performance Martial Arts LLC, DBA The Hero Dojo and Saber Club, at 301 W 4th St, Suite #151, Tucson, AZ 85705. These activities include, but are not limited to: Taekwondo, Gumdo/Kendo, swordplay, Lightfencing, self-defense seminars, archery, sharp sword target cutting (tatami mats, paper), and general fitness exercises.

I understand that participation in these activities involves inherent risks. Common injuries may include joint strain, bruising, sprains, and abrasions. Less common injuries may include broken bones, burns, minor cuts, and hyperthermia. Rare but serious injuries could include large cuts, amputation, neurological damage, and even death.

I further acknowledge that The Hero Dojo and Saber Club have implemented safety protocols, which I agree to follow. These include not sparring without supervision, wearing safety gear during sparring, only using advanced weapons (such as archery equipment, aluminum swords, or sharp swords) with instructor approval, conducting partner drills exclusively with padded or foam swords unless explicitly permitted and supervised, and remaining aware of my surroundings to prevent harm to myself or others.

In consideration of being allowed to participate in these activities, I, for myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and hold harmless Peak Performance Martial Arts LLC, their instructors, employees, sublessors, agents, affiliates, and representatives (collectively referred to as the “Releasees”) from any and all claims, liabilities, or causes of action arising out of or related to my participation in these activities, including any negligence on the part of the Releasees, to the fullest extent permitted by law.

I affirm that I am physically fit to participate and have not been advised by a medical professional to avoid physical activity. I will adhere to all safety rules, respect fellow participants, and engage in all activities with self-control and sportsmanship. Furthermore, I will report any significant hazards or unsafe conditions to an instructor or staff member immediately.

I agree to indemnify and hold harmless the Releasees from any claims, demands, or damages, including reasonable attorneys’ fees, resulting from my participation in these activities or breach of this agreement.

FOR PARTICIPANTS OF MINORITY AGE (UNDER AGE 18 AT THE TIME OF REGISTRATION)

This is to certify that I, as parent/guardian with legal responsibility for this participant, have read and explained the provisions in this waiver/release to my child/ward including the risks of the activity and his/her responsibilities for adhering to the rules and regulations. Furthermore, my child/ward understands and accepts these risks and responsibilities. I for myself, my spouse, and child/ward do consent and agree to his/her release provided above for all the Releasees and myself, my spouse, and child/ward do release and agree to indemnify and hold harmless the Releasees from any and all liabilities incident to my minor child’s/ward’s involvement or participation in these activities as provided above, EVEN IF ARISING FROM THEIR NEGLIGENCE, to the fullest extent permitted by law.
